Terms of Use

1. Definitions

• Ask — the item price set by the seller, stored in euro.
• Buyer / Seller — the account that pays or that lists the item.
• Deal — a reserved or paid order for one listing.
• Hold — funds collected by Stripe and not released to the seller until the rules in Article 11 are met. This is a contractual hold, not a statutory escrow account under Dutch law.
• Listing — an offer of a physical item on the Service, new or used.
• Pool — one of four closed markets: EU-27, United Kingdom, United States, Canada. There is no cross-pool shipping.
• Vondi costs — the buyer-side service charge of 5% of the Ask plus €0.70, or the then-current amount shown at checkout.
• Visual check — an automated photo review for certain luxury brands. It is not authentication, certification, or a guarantee of genuineness.

2. The Service and our role

Vondi Market is a consumer-to-consumer marketplace. You may browse listings without an account. Posting, buying, chatting, saving, wallet use, labels and tax forms require a real account (email and password). The website does not create anonymous authentication users for browsing; guests read the public catalogue with the publishable anon key under row-level security.

Movibyte Studio is not a party to the contract of sale between Buyer and Seller, except where mandatory law says otherwise. We are not a bank, electronic-money institution, or licensed payment institution. Payments are processed by Stripe. We do not take title to listed goods. We do not store card numbers.

The Vondi scanner (price comparison, scan quota, RevenueCat subscriptions) is a separate product. These Terms cover Market only. Scanner terms remain those published for the app until expressly replaced.

Some features — checkout and payment, offers, boosts, in-app messaging and payouts — may be switched off or offered only in selected pools while we roll out the Service. A feature shown as unavailable cannot be used and creates no obligation for us to provide it by any date. These Terms apply to each feature from the moment it is made available to you.

3. Eligibility, account and acceptance

You must be at least 18 and able to form a binding contract. The Service is for private individuals acting as consumers. Professional or business-scale selling (a Vinted-Pro style shop, VAT-registered trade as the primary use) is not offered on these Terms. We may later add business seller rules; until then we may suspend accounts that are clearly commercial.

You must provide a true email, a password of at least eight characters, and — before you sell or buy with shipping — a complete ship-from / ship-to address (first name, last name, street, number, postal code, city, country, phone). US and Canada also require a two-letter state or province.

First entry to the catalogue requires acceptance of these Terms, the Privacy Policy and the Cookie Notice (version cookie vondi_legal). Account users additionally accept the Market acknowledgement shown on first Market use. A new document version requires a fresh acceptance. Stripe Connect terms apply separately when you cash out.

You are responsible for your login. Do not share it. Notify us if you suspect misuse. One person should not operate multiple accounts to evade a ban, fee, or reporting duty.

An account can only be created after you tick that you accept these Terms, the Privacy Policy and the Cookie Notice and confirm that you are 18 or older; the button stays inactive until you do. We record that acceptance — document version, date and time, channel (website, app, Apple or Google sign-in), language, and the IP address and browser identification used — in a log that you cannot change, as proof of the contract. When a material new version is published, you must accept it before you can continue to use account features. If you do not accept, you can sign out and ask us to delete your account.

4. Market pools and territory

Listings are visible only inside the Buyer’s pool. EU-27 countries share one pool. The United Kingdom, the United States and Canada are each a separate pool. Switzerland, Norway and other countries are not open. You must not attempt to ship or pay across pools. We may hide or cancel a deal that would cross a pool wall.

5. Listings

A listing is an invitation to treat unless and until a Deal is reserved or paid under Article 8. You must own the item or be entitled to sell it. Descriptions, photos, size, condition and Ask must be accurate. Photos must be of the actual item, not a screenshot of another marketplace.

You must not list, among other things:

• Weapons, ammunition, explosives, or illegal knives;
• Drugs, cannabis products offered as such, or prescription medicines;
• Counterfeit, replica, or “superfake” goods;
• Stolen goods, fake identity documents, or access to hacked accounts;
• Pornography, sexual services, or any sexual content involving minors;
• Any offer of a person, child, or human body part as a product (immediate ban);
• Live animals;
• Motor vehicles, real property, or other off-catalogue bulk goods (sofas, white goods, pianos, mattresses) that the Service does not ship;
• Anything illegal in your pool or in the destination country.

Children’s clothing may be listed. Offering a child as the product may not. We filter text and moderate photos (including automated review). Severe violations can ban the account immediately. Other prohibited listings can attract strikes and a ban on repeat. We may remove, pause or refuse any listing without transferring ownership of your photos to third-party sellers.

6. Luxury visual check

Certain hard-luxury brands at or above a stated Ask (currently €150) stay paused until you submit six specified photos. Those photos may be reviewed automatically (including by a third-party model). A pass is not a certificate of authenticity, not an appraisal, and not insurance. A fail is not by itself a ban. You remain responsible for what you sell. Buyers must still inspect the item on arrival.

7. Price, Vondi costs and postage

The Ask is stored in euro. Display in GBP, USD or CAD is a conversion for viewing and does not change the stored Ask. The Buyer pays, unless we later publish a different split:

• the Ask (the seller keeps this amount when the Deal is released);
• Vondi costs: 5% of the Ask plus €0.70;
• postage if the item ships, at the prepaid card shown at checkout for the pack size and route. Local pickup has no postage.

The Seller chooses pack size S–M–L–XL. The Buyer chooses the live carrier on that route. If the packed item is larger than declared, the carrier may surcharge; that surcharge is between the users and the carrier, not a change to Vondi costs. We may refuse a checkout whose client-sent totals do not match the server-calculated Ask + Vondi costs + postage.

8. The contract between users

When payment is captured or a wallet-only pay completes, a Deal is formed between Buyer and Seller for that listing. The Seller must ship or hand over the described item. The Buyer must pay the totals shown and, for shipping, provide a deliverable address. Title and risk pass according to the fulfilment method and mandatory law of the pool; as a default, risk passes to the Buyer when the carrier first scans the outbound parcel or, for local handover, when the Buyer takes the item.

Distance-selling withdrawal rights under EU consumer law apply to trader-to-consumer sales. Sales on Vondi are intended as consumer-to-consumer. The 14-day withdrawal right therefore does not apply between users, except where a court or authority re-characterises a seller as a trader. In that case that seller must honour the statutory right. The Service’s return path in Article 11 is contractual and is not that statutory right.

9. Payment, hold and wallet

Checkout is provided by Stripe (including Stripe Checkout and Stripe Connect). Card and local payment methods are Stripe’s, not ours. A wallet credit may reduce the card amount. Until release, funds are held by Stripe under its terms. We may call Stripe to create, finalise, release, refund, open a lost claim, or pay out.

A listing can have only one winning paid Deal. A second successful payment is refunded (already sold). You authorise us to instruct Stripe accordingly.

Wallet credits arise only from released sales or specified refund paths. Cash-out requires a Stripe Connect account in your name. Stripe’s identity and payout checks apply. The same bank identity used on two accounts may be blocked. We may refuse a payout that would breach law, these Terms, or Stripe’s rules.

10. Shipping and labels

Where the Deal is ship, the Seller must create the outbound label through the Service (DHL, PostNL, Mondial Relay, USPS, FedEx or Canada Post, as offered for that pool). The Buyer pays the postage shown at checkout. Labels and tracking use the shipper and receiver addresses. You authorise us to send those addresses, phone numbers and emails to the chosen carrier. A carrier may refuse a label (wrong_market or contract limits). That is not a Vondi refund of the Ask unless Article 11 applies.

Local pickup is arranged between users. Chat stays on Vondi. We are not present at handover and are not liable for a failed meetup.

11. Confirmation, returns and lost items

After a delivery scan, the Buyer has a short confirmation window (currently two days, unless the Deal page shows otherwise). If the Buyer does not confirm or open a return in time, the Service may auto-release the Ask to the Seller. Confirming authorises release.

A return may be started while the Deal is still in a returnable status (typically sold, not after released). After release there is no platform return. Lost-in-transit claims follow the Deal actions we expose (including lost-open). Refunds, if due, are instructed through Stripe and may return to the original method or the wallet as the payment path allows.

We are not the carrier and do not guarantee delivery times. We are not obliged to pay either party from our own funds if Stripe, a bank, or a carrier fails, except where mandatory law requires it.

12. Chat, profiles and conduct

Each listing has one in-app thread. You must not move the deal off-platform. Messages that contain WhatsApp, other messengers, websites, email addresses or phone numbers are blocked. Do not harass, defraud, or share another person’s data. Public profiles (handle, bio, avatar, country) and reviews from completed Deals may be shown to others in the pool. Follows are optional.

13. Taxes and DAC7

You are responsible for your own taxes. Private decluttering is often untaxed; regular trade may be taxable. That is your assessment, not ours.

When Vondi mediates and pays out, Movibyte Studio is a platform operator under EU DAC7 (in the Netherlands: Wet implementatie DAC7). If you reach the reporting threshold in a calendar year — currently 30 released sales or more than €2,000 received, counting released Deals only — we must report prescribed data to the Dutch Tax Administration, which may exchange it with other Member States. We will ask for legal name, address, date of birth, TIN and issuing Member State, and related fields, only when reporting is required or shortly before. Failure to file after the published deadline can block payouts and new sales (buying may remain). Completing the form restores access. A TIN (including a Dutch BSN) is stored encrypted. Reporting is not itself a tax assessment against you.

14. Intellectual property

Vondi, the wordmark, and the Service software are ours or our licensors’. You keep ownership of your listing photos and text. You grant us a worldwide, non-exclusive, royalty-free licence to host, cache, moderate and display them to operate the Service, for as long as the listing or thread exists and for a reasonable backup period. You must not upload content that infringes others.

15. Privacy

Personal data is processed as described in the Privacy Policy. Cookies are described in the Cookie Notice.

16. Liability

The Service is provided as a technical intermediary. To the maximum extent permitted by mandatory law we are not liable for: the quality, safety or legality of items; the truth of listings; a dispute between users; carrier delay or loss except as we choose to operate a lost-claim path; Stripe or bank outages; or unavailability of the site.

Nothing excludes liability for intent, gross negligence, death or personal injury caused by negligence, or any liability that cannot be limited under Dutch or other applicable mandatory law. Where we are liable and a limit is allowed, our aggregate liability to you in a calendar year is limited to the greater of €100 and the Vondi costs you paid us in that year.

You indemnify us against claims arising from your listings, items, messages, or breach of these Terms, except to the extent caused by our intent or gross negligence.

17. Suspension and bans

We may pause listings, freeze payouts, cancel unpaid reserves, or close an account where we reasonably suspect fraud, prohibited goods, sanctions evasion, chargeback abuse, multi-accounting, or a legal demand. Severe listing content can ban immediately. You may write to info@movibytestudio.com to contest a measure. We will not provide a playbook for evading filters.

18. Duration and deletion

These Terms apply until you stop using the Service or we close the account. You may request deletion. Deletion is currently completed from the Vondi app (including a cooling-off window described there). We will add the same control on the website. We retain data required for Deals, payouts, DAC7, chargebacks and legal claims for the statutory period.

19. Complaints and illegal content

For a Service complaint, email info@movibytestudio.com. For allegedly illegal listings (EU Digital Services Act notice), include a precise URL or listing id, the legal basis, and your contact details. We will assess and may remove or restrict content. This is a notice-and-action channel, not a pre-publication licence.

20. Changes

We may change these Terms. The new version applies after we publish it and, where the change is material, after you accept the new vondi_legal version or continue using the Service after notice. Deals already paid follow the Terms in force at payment, except where a change is required by law.

21. Governing law and disputes

These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules that would point elsewhere. If you are a consumer habitually resident in the EEA or the United Kingdom, you also keep the mandatory protections of that country. Courts of the Netherlands have jurisdiction, without prejudice to any mandatory consumer venue. The EU ODR platform is available to EEA consumers; we are not obliged to use a particular ADR body unless required.

22. Miscellaneous

If a clause is invalid, the rest stays in force. You may not assign the contract without our consent; we may assign it to an affiliate or successor of the Service. These Terms are the entire agreement for Market use and prevail over any prior Market draft on this site. Every language version we publish (Dutch, English, German, French, Spanish, Italian, Polish, Portuguese) is authentic. If they conflict, the version you accepted (the language shown when you ticked the boxes) prevails; if that cannot be shown, the Dutch text prevails.
